Ferrero Privacy Notice

We, at Ferrero, are committed to respecting the right to data protection and the right to privacy of our business partners/retailers (“you”). In line with this commitment, we wish to provide you with this information notice (the “Notice”), in which we explain the way we collect and handle your personal data in the context of the targeted communication using WhatsApp Business Account (“Targeted Communication”).

For implementing this Targeted Communication, Ferrero has appointed Vendant Innovision as its authorized representative to carry all acts on behalf of Ferrero India in this regard as per the applicable data privacy laws and regulations of India. The contents of this Privacy Notice shall be equally binding on Vedant Innovision, to the extent applicable.

1. Who are we and how to contact us?

Ferrero India Private Limited is located at Plot no F 13, MIDC Baramati, Pune 413133. Ferrero India Private Limited is part of the Ferrero Group, which has established its global headquarters at 16 Route de Trêves, L-2633 Senningerberg, Luxembourg (together, “Ferrero” or “we”). When collecting and processing personal data for this Targeted Communication, Ferrero acts as a data controller/data fiduciary and Vedant Innovision acts as a data processor.

2. What personal data do we collect, for what purpose, and on what legal basis?

We only collect personal data that is necessary to send you Targeted Communication using the WhatsApp business account, with the overall purpose of retailer engagement and enhancing retailer experience.

• Profile & Contact data: we will collect your name as well as your personal mobile no. or business mobile no. (at your discretion).

The purpose behind collection of this data is to communicate your monthly target achievement, incentives, festive greetings, announcement of new product launches, etc., and to improve your overall engagement and enhance business experience with Ferrero.

3. How long do we keep your personal data?

Your personal data are kept for no longer than necessary for achieving the above-mentioned purpose. In particular, the profile and contact data shall be retained by Ferrero and Vedant Innovision for as long as necessary for the fulfilment of the purpose.

4. With whom do we share your personal data?

Ferrero is committed to ensuring the confidentiality of your personal data. By default, Ferrero will never share your personal data with third parties outside of the Ferrero Group.

5. Do we transfer your personal data to another country?

As a rule, your personal data will only be processed in India.
